Terms and Conditions of booking
The booking must be made by a person over 18 years of age who agrees on behalf of all named persons to abide by this Contract.
Contract – When you submit a booking via our website www.cologin.co.uk or by phone on 01631 564501 OR via a third-party booking agent you will receive an email detailing the booking to the email address you provide in the booking form. This does not form a contract between us. A contract shall only arise when your deposit payment has cleared and your booking is subsequently confirmed in writing by email. The Contract shall be deemed to have been made at our offices at Cologin and be subject to Scottish Law and the exclusive jurisdiction of the Scottish Courts. These conditions of hire form the basis of our contract with you. If you make a booking by phone we will confirm by email and send our terms and conditions for acceptance. Any information you give us with your booking is held securely on our computer booking system and dealt with in accordance with the Data Protection Act. By providing us with this information you are deemed to accept this and to have the consent of all members of your party. Cologin has a Privacy Policy and we do not provide your personal data to any third party.
Terms – The prices shown include the provision of bed linen and towels. Fuel including oil and electricity is included as part of the rental and is based on a ‘fair usage’ policy. We monitor electricity usage and urge all guests to be mindful of consumption. We reserve the right to charge for excessive use of electricity. VAT is also included at the applicable rate as set by the UK government. This tax is collected by us on behalf of the government and we reserve the right to alter prices and pass on the increase should the VAT rate change. Prices may be discounted for various reasons, however, only one discount is ever applicable and (in general) discounts only apply off season. Retrospective refunds are not permitted against any offer or promotion advertised after a booking has been made.
A security deposit of £200 applies to all bookings for Cologin Farmhouse. This will be held against a credit card via our booking system. Should you arrive at Cologin with a group which does not meet your booking criteria we reserve the right to refuse the use of the accommodation. You may be asked to pay an additional security deposit at the time of take-over. We also reserve the right to refuse to hand over accommodation to anyone who, in our opinion, is not suitable to take charge of it. In such cases, all hire charges paid will be refunded in full and the Contract shall be cancelled. If, in our opinion, anyone is not suitable to continue the holiday because of unreasonable behaviour, damage to property, or annoyance to other guests, the Contract may be terminated. In this event no refund will be given and any damage caused to the holiday home will be charged against the card used to pay for the booking. We have the right to enter any accommodation (without prior notice if this is not practicable or possible) if special circumstances or emergencies arise.
No Smoking – SMOKING is strictly prohibited in all properties and shared amenity areas. Removal of smoke odours in buildings is extremely difficult and we reserve the right to evict anyone who we suspect is smoking or drug taking in any of our properties. Charges will be made to the guest to cover the costs of any cleaning, deodorising and any loss of future rental revenue which may occur as a result of smoking within a property.
Booking and Payment – Your booking is only confirmed on receipt of your deposit (25% or a minimum £100) and a non-refundable booking fee of £22 to cover administration. We advise you to seek appropriate holiday insurance for your booking and all bookings must accept our booking terms and conditions regarding cancellation. The final balance must be cleared at least 42 days before your holiday start date and will include any booking extras that have been made. For bookings made within 42 days of your holiday start date the full payment is required at the time of booking. Payment can be taken by bank transfer, credit or debit card. Please do not send money through the post. Third party vouchers can be used for payment only once verified and redeemed. Payments made in this way cannot be refunded.
It is now possible to pay your final balance in instalments. Please advise us if you would like ‘custom payments’ enabled on your booking to allow this feature for online payments only. There is no extra charge for paying by instalment using the guest log in and receipts will be issued on request.
Cancellation by You – If you need to cancel your holiday for any reason, send us written/email notification and your cancellation will be effective from the date of receipt. When you make a booking at Cologin you are required to take out appropriate cancellation insurance to cover your stay. You may also opt to add ‘enhanced booking protection’ during the booking process through our partnership with XCover (Booking Protect). Please check that your provider will provide appropriate cover against financial loss if you subsequently cancel your booking – most companies (including Booking Protect) will refund only against the reasons outlined in their policy and proof will always be required.
• If you cancel more than 90 days prior to arrival we will refund your payment (less the non-refundable booking/admin fee).
• If you cancel after that time we will only refund your payment, provided we can resell the property. (The refund may be less than the original payment if we have incurred additional marketing costs and/or discounted the dates to generate a sale.) Alternatively we may be able to transfer your payment to a new date (within the same financial year and subject to availability) – please note, any increase in rental rate due will be passed on and an admin fee will be applied. The booking will be subject to your original booking terms and conditions.
• If you cancel within 42 days of the start of your holiday, then you will be held responsible for the full cost of your booking and no refund will be given.
Changes by You – If you wish to alter your booking details please do so by email and we will do our best to accommodate your request. An admin fee of £22 is applicable which may be waived at our discretion. Booking extras added via the guest portal do not carry an admin fee. We cannot guarantee to accept changes to your booking within 14 days of the arrival date and some booking extras cannot be added within 7 days of your arrival.
Changes by Us – Whilst we are happy to accommodate requests for particular properties we reserve the right to change your booking from one property to another of the same standard or higher without discussion or consultation.
Cancellation by us – We regret we cannot accept responsibility or pay any compensation where the performance or prompt performance of our contract with you is prevented or affected by reason of circumstances which amount to force majeure. Circumstances amounting to force majeure include any event which we could not, even with all due care, foresee or avoid. Such circumstances include the destruction or damage of your holiday home (which cannot reasonably be remedied to a satisfactory standard before the start of your holiday) through fire, flood, explosion, storm or other weather damage, break-in, criminal damage or any similar event. Such circumstances also include riots or civil strife, industrial action, natural or nuclear disaster, fire, adverse weather conditions, war or threat of war, pandemic, actual or threatened terrorist activity and all similar situations beyond our control. In such an event we will endeavour to offer you alternative holiday accommodation or an alternative date if available. If we cannot do so or if you do not wish to accept the alternative we offer, we will issue a credit voucher or refund all monies you have paid. Where any cancellation or change results from force majeure, our liabilities are limited to offering you an alternative holiday home (where available) or refund as set out above. We cannot accept responsibility for any material loss, damage or additional expenses or inconvenience directly or indirectly caused by or arising out of the property its plumbing, heating, electrical services or exceptional weather.
Occupancy – Occupancy shall be from 4pm on the day of arrival to 10am (latest) on the day of departure – unless special arrangements have been made late departures may incur a £25 penalty The lodges are rented as a holiday let (AKA secondary let, short term let by the Scottish Government) and are therefore not a private residential tenancy (see paragraph 6 of schedule 1 of the Private Housing (Tenancies) (Scotland) Act 2016). The hirer shall use the accommodation solely for holiday purposes and the Hirer shall not sub-let the properties or any equipment hired to the hirer. We always endeavour to have your property prepared and ready for 4pm, however occasionally there may be an unavoidable delay. If we cannot provide the property you originally booked we reserve the right to offer an alternative property of the same or better standard.
The total number in your party must not exceed the capacity of the accommodation as advertised except for babies under 2 in our Inner Hebridean lodges, Cruachan and Cologin Farmhouse only, and if they are not using a bed. (We cannot provide a cot in our one bedroom chalets and we do not regard these properties as suitable for infants.) All male/female, stag hen and non-family groups are accepted only at our discretion and will be liable for a £50 security/housekeeping deposit per property (the farmhouse security deposit would also be due). Whilst we have properties specially adapted to make them suitable for assisted wheelchair users, the disabled visitor should normally be accompanied by others to attend to their mobility requirements. It is essential that such parties state any special needs at the time of booking. We will do our best to accommodate every visitors’ needs or point out which facilities may be unsuitable.
Departure and Cleaning of Property – Your rental includes an end of stay clean however your contract with us requires you to leave the property clean, tidy and undamaged. The following basic level of cleanliness is required: empty all bins and leave cookers and ovens clean and fat-free. Crockery, cutlery, pans, glasses and equipment should be left washed and drying or the dishwasher filled and left on in the farmhouse. Obvious spills and stains should be removed and any equipment or furniture that has been moved during the let should be returned to its original position. This is especially important if you have booked a group of properties. Failure to meet this standard will result in a cleaning charge. To help our cleaning staff on changeover day it would be helpful if you could also turn off all heaters, strip used bedding and leave wet towels etc in the bath/shower tray. Please don’t leave perishable food items and remove all rubbish. Do a final check that you’ve taken all your belongings and leave your key in the outside of the front door so our changeover teams can access your property as soon as you leave. If there is any damage to report please do so before you leave.
Dogs and Pets – Pets are welcome but MUST be pre-booked. We charge £5.00 per pet, per night. We accept up to two pets in the Inner Hebridean lodge, Cruachan or Cologin Farmhouse but one pet only in our one-bedroom Outer Hebridean chalets. There is no charge for guide dogs. Bring your pet basket/blanket and pooper scooper with you and please keep pets off bedding or other soft furnishings. Only well-behaved pets should be left unattended in the lodge and then only for short periods of time. Any damage caused by pets will be charged for. When exercising your pet on the park it must be on a lead. Please clean up any fouling without delay; special bins are provided throughout the park.
Hot Tubs – There is a wood burning hot tub in Cologin Farmhouse. On departure the tub is cleaned and sanitised. We do not charge extra for using the tub on a DIY basis, however, if you wish us to fill the tub and fire up the wood burning stove there is a fixed charge of £150 which includes a full log store. We regret that on a changeover days we cannot guarantee that the tub will be hot for arrival as the water will take several hours to heat. Please ensure that you read the individual guidelines for use – any damage will be charged for.
We regret that we cannot allow inflatable hot tubs to be used at Cologin without prior consultation and our written permission. We have a couple of lodges which have suitable decks and privacy but these properties may not be available for the dates you require and we will not allow a ‘hired’ hot tub to be used anywhere else at Cologin. Our Hot Tub rules apply and as a family park we will not tolerate any noise or disturbance to other guests. (Our quiet time is from 10pm.)
Groups – In all circumstances the lead booker is responsible for the behaviour of all persons booked. Family and friends who know each other and / or travel together will be considered as making a group booking even if they have made separate bookings. We cannot accept individual payments towards the balance of a group booking unless properties have been booked separately and we hold full contact details of the lead booker for each property.
Vehicles – Your vehicles and their accessories and contents are left entirely at your risk. We will not be responsible for any loss or damage from or to any vehicle from any cause whatsoever other than in the case of negligence of our employees or agents. Please only park in designated parking areas and never on the grass or paths. If you have booked the farmhouse please do not park inside the farmhouse courtyard and do not obstruct access to other private houses at Cologin. Do not run electricity charge cables from any property to an Electric Vehicle. This will invalidate our insurance and could result in an electrical fire. We have two Chargeplace Scotland EV charge points on site and these are the only acceptable methods of charging an EV vehicle. (Charges apply)
Changes to Advertised Services or Facilities – We reserve the right to vary or withdraw any on-site service or facilities as advertised without prior notice. We do not warrant, and we are not responsible for the accuracy of any verbal information given or statements made by any of our representatives. Further, whilst we aim to ensure that the information and descriptions we provide are accurately conveyed on our own website (https://www.cologin.co.uk) we cannot be held responsible for third party websites or unauthorised listings on other websites and advertisements. Please note, there may be small differences between the actual accommodation and its advertised description on our own website as photographs of accommodation are examples only and furnishings, layout and decoration may vary.
Our Home – Cologin is a family run business in a rural location. There are areas of uneven ground, natural hazards including water, unmade paths and limited lighting. Please take extra care when moving around. We recommend all our guests bring a torch (most smart phones have a torch function) to enhance movement around the park during the hours of darkness.
Please ensure that you are aware of natural features such as loch, rivers, burns and supervise pets and children accordingly. Note, popular houseplants, trees (both native and ornamental) plants and shrubs can cause illness if ingested. Please ensure that children are not using the playpark without adult supervision and do not leave children or pets alone in our properties. Finally, as Cologin is our home we ask all guests to avoid late night noise and inconsiderate behaviour. We have a quiet policy between the hours of 22:00 and 08:00 and thank you in advance for your co-operation.
Liability – We cannot accept liability for any damage, expenses, injury, death or loss of any nature whatsoever suffered by any person(s) from any cause other than in the case of the negligence of our employees or agents. Please note, we cannot accept liability for failures in the wifi network or other facilities provided by third party suppliers available to guests at Cologin. We will not be held responsible for any items left behind or lost property. We would remind guests to check you have taken all your belongings with you before departure. You are responsible for your personal possession whilst at Cologin and we are not responsible for any loss of damage to these.
Cologin has a rural location – at times we will experience adverse weather conditions. We aim to keep our driveway and main entrance clear but at times of icy conditions or heavy snowfall, direct-to-the-door access to all properties may not be possible. We cannot be held responsible for travel disruptions resulting in non-arrival because of bad weather. Certain facilities may not be available due to bad weather and we may remove/close facilities to prevent damage as per our health and safety responsibilities. Please note, if you have booked the pre-fill service for the hot tub in the farmhouse and there is adverse weather forecast during your stay we will contact you before your arrival to rearrange the service or refund the ‘extra’ as we do not allow the hot tub to be used in excessively wet or windy weather.
Shortcomings and Complaints – It is important to us that you enjoy your holiday and we will make every effort to ensure that your stay at Cologin is enjoyable. However, in the event of any concerns with your property please notify us immediately so that corrective action can be taken. We cannot accept liability in relation to any shortcomings or claim of whatever nature if you fail to notify us of any complaint or claim during your holiday. Unfortunately, no refund or compensation claim will be processed after the holiday has taken place and any claim which has not been reported to management will be rejected. Cologin is a family owned and run small business and we all live and work here.
